These Terms and Conditions ("Agreement") govern the use of the Honey Badger Car Rental platform, including the website, mobile application, and related services. Honey Badger operates as a digital marketplace connecting vehicle owners ("Lenders") with individuals seeking to rent vehicles ("Renters"). Honey Badger is not the owner of vehicles listed by independent Lenders. By registering an account, browsing the Platform, listing a vehicle, making a booking, or otherwise using the Platform, you acknowledge that you have read, understood, and agreed to be legally bound by these Terms. If you do not agree, you may not use the Platform.

"Platform" — the Honey Badger Car Rental marketplace. "Renter" — a registered user who books or intends to book a vehicle. "Lender" — a registered user who lists a vehicle for rental. "Booking" — a confirmed rental arrangement between a Lender and a Renter. "Vehicle" — any car or motor vehicle listed on the Platform. "Commission" — 6% fee payable to the Platform by the Lender per completed booking (Lender keeps 94% of the rental subtotal). "Service Fee" — 2% fee payable to the Platform by the Renter, added at checkout. "Annual Subscription Fee" — USD $12 per year per Lender account. "KYC" — Know Your Customer verification procedures. "Trust Score" — the Platform's internal reputation and verification rating system.

To use the Platform, you must: 1. Be at least 18 years old; 2. Possess legal capacity to enter into binding agreements; 3. Provide accurate and truthful information; 4. Hold a valid Zimbabwean or internationally recognised driver's licence if renting a vehicle; 5. Comply with all laws of Zimbabwe. Honey Badger reserves the right to refuse registration, suspend accounts, or terminate access where eligibility requirements are not met.

4.1 Honey Badger acts solely as an intermediary marketplace facilitating introductions and bookings between Renters and Lenders. 4.2 Honey Badger does not own, inspect, maintain, insure, or control vehicles listed by independent Lenders. 4.3 The rental agreement for each booking is concluded directly between the Lender and the Renter. 4.4 Honey Badger is not responsible for vehicle condition, mechanical defects, roadworthiness, conduct of users, accidents or injuries, theft or loss, traffic offences, or third-party claims. 4.5 Honey Badger reserves the right to monitor platform activity and enforce compliance with these Terms.

Users must provide: full legal name, valid email address, valid mobile number, National ID or passport details, date of birth, and any additional KYC information requested. Honey Badger may request: driver's licence verification, proof of residence, selfie verification, vehicle ownership documentation, and banking details. Users warrant that all information submitted is true, accurate, and current. Providing false information constitutes a material breach of these Terms and may result in immediate suspension or legal action.

Lenders agree to: legally own or have lawful authority to rent listed vehicles; ensure roadworthiness and valid insurance; honour confirmed bookings; maintain accurate listings and availability calendars; and comply with all applicable laws. Prohibited vehicles include stolen, unlicensed, uninsured, and unsafe vehicles. Platform Commission: 6% of every completed booking, automatically deducted from the Lender before payout, so the Lender receives 94% of the rental subtotal. Annual Subscription: USD $12 per year. Failure to pay may result in listing suspension, withheld payouts, or restricted access. Lenders are solely responsible for declaring rental income, paying taxes, and ZIMRA compliance. Honey Badger shall not be responsible for any Lender tax liabilities.

Renters agree to: use vehicles lawfully and responsibly; hold a valid driver's licence; return vehicles on time and in the same condition; and pay all applicable fees. Renters may not: drive under the influence; sub-rent vehicles; use vehicles for illegal activities; drive outside permitted geographic areas without consent; transport illegal goods; or allow unauthorised drivers to operate the vehicle. Renters are responsible for traffic fines, parking tickets, toll fees, vehicle damage, and fuel costs during the rental period. Vehicles must be returned with the agreed fuel level.

A booking becomes binding once payment is authorised and the booking is confirmed by the Lender or through Instant Book. Accepted payment methods: Visa, Mastercard, EcoCash, OneMoney, bank transfers, and other approved methods. Pricing may be displayed in USD or ZWL. Exchange rates are indicative. Lenders may require refundable security deposits. Deposit conditions must be disclosed before booking.

Each listing specifies one of four cancellation policies: Flexible, Moderate, Strict, or Non-Refundable. The applicable refund is displayed before booking. Platform service fees may be non-refundable. Where a Lender cancels without lawful justification: the Renter may receive a full refund; the Lender may incur penalties; repeat violations may lead to suspension. Users agree to first attempt resolution through the Platform dispute process by submitting evidence (photos, messages, receipts, police reports). Honey Badger may investigate and make interim determinations. These decisions are final for platform administration purposes. These Terms are governed by the laws of Zimbabwe. Unresolved disputes may be submitted to Zimbabwean courts.

Users may leave reviews after completed bookings. Reviews must be truthful, not defamatory, not contain hate speech, and not violate privacy rights. Honey Badger reserves the right to remove non-compliant reviews or content.

Honey Badger collects identity, contact, payment, device, and usage data. This data is used for: identity verification, fraud prevention, service delivery, customer support, and legal compliance. Data may be shared with payment processors, insurers, and law enforcement where legally required. See our Privacy Policy for full details.

Users may not: commit fraud, impersonate others, manipulate reviews, circumvent platform payments, share misleading information, attempt unauthorised system access, or interfere with Platform operations. Such conduct may result in suspension, legal action, or criminal reporting.

Honey Badger may suspend accounts, remove listings, withhold payouts, or permanently terminate access for: fraud, repeated cancellations, unsafe conduct, abuse of the Platform, or breach of these Terms. Users remain liable for obligations incurred before termination.

To the maximum extent permitted by Zimbabwean law: 1. Honey Badger shall not be liable for indirect, incidental, or consequential damages; 2. Honey Badger shall not be liable for accidents, injuries, theft, or losses from vehicle rentals; 3. Total liability shall not exceed platform fees received for the disputed booking. Users acknowledge that vehicle rentals involve inherent risks.

Users agree to indemnify and hold harmless Honey Badger and its representatives from claims arising from: breach of these Terms, misuse of the Platform, vehicle damage, traffic offences, injury, death, or violation of laws.

All Platform branding, logos, software, and content are the intellectual property of Honey Badger. Users may not reproduce or exploit Platform content without written consent.

Users consent to receiving emails, SMS, push notifications, and platform communications. Users may opt out of marketing but not essential service communications.

Honey Badger may amend these Terms at any time. Updated Terms become effective upon publication. Continued use constitutes acceptance of revised Terms.

These Terms constitute the entire agreement regarding Platform use. Unenforceable provisions do not affect the remainder. Failure to enforce a right is not a waiver. Users may not assign obligations without written consent. Electronic acceptance constitutes valid, binding consent.
